These terms and conditions ("Terms") apply to the provision of services provided by Neisa Tracking Services Private Limited (referred to as "TrakMe", "we" or "us") to users of the TrakMe App. The term "you" refers to the end user of the App who intends to use the App. It is a condition of our providing the Service that you accept these Terms. Please read these terms and conditions ("Terms of Service") carefully before using any of our services. These Terms of Service represent the agreement ("Agreement") between you and Neisa Tracking Services Private Limited with respect to any Software or Services developed / offered by Neisa Tracking Services Private Limited (Later referred to as (referred to as "TrakMe", "we" or "us")). All references herein to "you" and "your" means you who creates an account on the TrakMe app and any other entity on whose behalf you accept these terms and conditions, all of whom shall also be bound by this Agreement. If the Service is being used on behalf of an entity by an individual authorized to agree to such terms on behalf of such entity, then "You" refers to the entity. If You are accessing the Service on behalf of Your employer, you represent and warrant that You have the authority to agree to these Terms of Service on its behalf. Your use of the Neisa Tracking Services Private Limited web site or any of the applications (eg. TrakMe app) indicates that you accept these terms and conditions. If you do not accept these terms and conditions, do not launch or otherwise use any application or service developed by TrakMe.

TrakMe takes your privacy seriously. As electronic commerce over the Internet increases and the volume of data transmission over networks steadily rises, maintaining the trust of users necessitates vigilant and responsible privacy protections. Once registration is requested, the user agrees to provide accurate and complete registration information. At the time of registration users are required to provide on TrakMe certain information which includes student's name, address (bus stop) and phone number of the parents. The User is allowed to select his / her own user ID and password. Users shall take reasonable precautions to protect against theft, loss or fraudulent use of such IDs and passwords, and Users are solely responsible for any losses arising from another party's use of such IDs and passwords, either with or without User's knowledge. The Children's Online Privacy and Protection Act ("COPPA") requires that online service providers obtain parental consent or provide notice before they knowingly collect personally identifiable information online from children who are under 13. TrakMe does not knowingly collect or solicit personally identifiable information from a child under 13, and hence the login is for parents and guardians of the ward.

TrakMe agrees that they shall hold this student and parent Information in confidence, and not disclose such Proprietary Information to persons not having a need to know such Proprietary Information consistent with the purpose for which it was transmitted and such Proprietary Information shall not be used, directly or indirectly, for any nonprofit, commercial, business or other purpose or in any way detrimental to the school or parents. TrakMe does not share, sell or rent users personally identifiable information to third parties. We will not share or distribute any user information with third parties except as provided below When required to do so by law or regulation, or in response to a request from a law enforcement or governmental agency or authority or to establish or exercise our legal rights or defend against legal claims. In order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of TrakMe terms of use, or as otherwise required by law.

TrakMe will not be liable for any damages of any kind arising from the use of the Service offered by the Company, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

The User agrees to allow TrakMe to contact you via phone or text message, to deliver certain services or information you have requested e.g. OTP for password reset.

These Terms and Conditions shall be governed by and interpreted in all respects in accordance with the laws of the Republic of India. The Parties hereby submit to the exclusive jurisdiction of the courts of Mumbai, India.
